1. Legal Regime (Civil Code)
This is a Seasonal Room Rental governed strictly by Articles 1542 to 1582 of the Spanish Civil Code. By applying, you acknowledge that:
- You have a permanent residence elsewhere.
- You are renting for a specific temporary cause (work, study, etc.).
- This contract does NOT grant rights to permanent housing (Vivienda Habitual) and is excluded from the LAU (Ley de Arrendamientos Urbanos).
2. Financial Requirements
- Solvency: You must provide proof of income (payslips, tax returns) sufficient to cover rent.
- Deposit: A 1-month security deposit is mandatory.
- Overstay Penalty: €50/day penalty for staying past the contract end date.
3. Occupancy Rules
- Room 1 & 2: Max 2 people (+€80 surcharge for 2nd person).
- Room 3: Max 1 person strictly.
- Guests: Overnight guest stays are not allowed.
- Quiet Hours: 22:00 to 08:00 must be respected.
4. Utility Supplement
A flat-rate utility supplement of €60/month per room is included in the total monthly payment. This supplement covers water, electricity and high-speed internet.
- The supplement is fixed and does not vary with normal seasonal fluctuations.
- If the total household utility bills (electricity + water + internet) in any calendar month exceed €60 per occupied room, the excess amount will be divided equally among the occupied rooms and added to the following month's rent, supported by copies of the invoices.
- Tenants are expected to use utilities responsibly. Excessive or wasteful consumption (e.g., leaving heating or AC running continuously with doors/windows open) will be considered a breach of the fair-use policy.
5. Digital Inspection Waiver
You agree to rent the property based on the provided photos/videos and waive the right to a physical visit prior to signing, acknowledging the property's condition as shown.
6. House Rules
- Smoking and fire safety: Smoking is strictly prohibited inside the property. No candles, incense, oil burners or any other open flame or fire hazard are permitted inside the property. Smoking is permitted in designated outdoor areas only.
- Pets: No pets allowed without express written authorisation from the landlord.
- Cleanliness of common areas: Tenants must organise among themselves to keep all common areas clean and in good order. Each tenant must clean up after each use of the kitchen, bathrooms, living room and other shared spaces. Leaving open food outside cupboards or on the counter overnight is not permitted. Repeated refusal to cooperate with the cleaning and upkeep of common areas may be treated as a breach of house rules.
- Walls and fittings: Tenants must not hang, nail, screw, glue or fix any items to the walls, doors, cupboards or other surfaces of the property without the landlord's prior written authorisation.
- Laundry equipment: Laundry drying racks must be stored inside the laundry room after use. They must not be left outside, as exposure to the weather will cause rust and deterioration.
- Waste disposal: Tenants must organise among themselves to take out the rubbish regularly and not allow waste to accumulate inside the property. The rubbish room is located to the left of the house, further down the same street, behind the white doors.
- Noise and parties: Quiet hours apply from 22:00 to 08:00. Playing music or videos at high volume in a way that disturbs other tenants or neighbours is not permitted. Parties or events inside the property are not allowed.
- Utilities: Included in the fixed supplement of €60/month per room. If total household bills in any calendar month exceed €60 per occupied room, the excess will be shared equally among the occupied rooms.
- Security: The front door must be locked when leaving the property. Windows must be closed when leaving if weather or safety requires it, and the alarm system must be used correctly if activated. Copying keys without the landlord's express written authorisation is strictly prohibited. Granting access to unauthorised persons is not permitted.
- Illegal activities: Any illegal, dangerous, insalubrious or seriously disruptive activity within the property is strictly prohibited.
- Guests: Guests must respect the other tenants and these house rules. Overnight guest stays are not allowed, out of respect for the other tenants and the agreed occupancy of the house. The tenant is fully responsible for the behaviour of their guests whilst on the premises.
- Damage and reporting issues: The tenant must promptly report leaks, breakages, pests, safety incidents or other relevant issues affecting the property. The tenant is responsible for damage caused by them or their guests beyond fair wear and tear and may be required to pay the reasonable cost of repair or replacement.
7. Inventory & Damages
At the time of signing, an inventory of the room's furniture and condition will be carried out. The tenant will be responsible for any damage or deterioration caused by them or their guests, beyond fair wear and tear, and may be required to repair the damage or reimburse the reasonable cost of repair or replacement. The deposit may be withheld in full or in part to cover such damages or outstanding debts (rent, utilities, cleaning).
8. Contract Resolution
- Serious breach, or repeated breach after written warning, of the house rules, non-payment of rent, unauthorised subletting or any fraudulent use of the property may result in early termination of the contract without prejudice to any applicable legal actions.
- Voluntary early termination by the tenant shall not entitle them to a refund of any advance rent paid, unless expressly agreed in writing.
