2. Data Collected

Through this application form we collect the following categories of personal data:

  • Identity data: Full name, date of birth, nationality, passport or NIE number, photograph (if provided).
  • Contact data: Email address, telephone number, current residential address.
  • Financial & employment data: Proof of income (payslips, employment contracts, pension slips, business registration), bank account details if required for deposit transfer.
  • Tenancy data: Requested room, rental period, reason for stay, declaration of primary habitual residence elsewhere.
  • Solvency certification: If provided, BDMI/FIM tenant solvency certificate number and issuing body.

3. Legal Basis for Processing

We process your data on the following legal bases under Article 6 GDPR:

  • Art. 6(1)(b) — Contractual necessity: Processing is necessary to assess your application and, if accepted, to execute and manage the rental contract.
  • Art. 6(1)(c) — Legal obligation: We are obliged to collect and report certain identity data to the Spanish National Police under Real Decreto 933/2021, which requires landlords to register guests and occupants with the Ministry of the Interior.
  • Art. 6(1)(f) — Legitimate interest: We verify solvency and assess application risk to protect the Landlord's property and financial interests, provided this does not override your fundamental rights.

4. Data Recipients

Your personal data may be shared with:

  • Spanish National Police (Policía Nacional / Guardia Civil): Identity and stay data as required by RD 933/2021.
  • Tax authorities (Agencia Tributaria): If required under applicable tax reporting obligations for rental income.
  • Professional advisors: Lawyers or accountants acting under confidentiality obligations, only as strictly necessary.

Your data is not sold, shared with marketing companies, or transferred outside the European Economic Area.

5. Data Retention

  • Rejected applicants: All data is permanently deleted within 30 days of the rejection decision being recorded, unless retention is required by law.
  • Unanswered / pending applications: All data is permanently deleted within 60 days of submission if no decision has been made, in accordance with the GDPR principle of storage limitation (Art. 5(1)(e)).
  • Successful tenants: Data is retained for the duration of the tenancy plus 5 years following contract expiry, for compliance with civil, tax, and administrative legal obligations.
  • Police registration data: Retained and transmitted in accordance with RD 933/2021 requirements; retention periods are governed by that regulation.

6. Your Rights

Under GDPR and LOPDGDD, you have the following rights regarding your personal data:
